Terms and Conditions
These Terms and Conditions apply when you engage Wastewater System Servicing to carry out servicing, maintenance, repairs, troubleshooting or other work on your wastewater treatment system.
By engaging our services, you acknowledge that you have read, understood and accepted these Terms and Conditions.
Services
Wastewater System Servicing provides routine wastewater treatment system servicing, maintenance, troubleshooting and repairs.
The frequency of servicing required will depend on your wastewater system, manufacturer requirements and any applicable council consent conditions.
Routine servicing does not automatically include repairs, replacement parts or additional remedial work. Where additional work or parts are required, we will advise you and, where appropriate, discuss this with you before proceeding.
In some circumstances, immediate work may be recommended where it is necessary to prevent further damage, system failure or a potential health or environmental issue.
Booking and Servicing
Appointments can be arranged by phone, email or through our website.
Where you are on a regular servicing schedule, we will contact you when your next service is due and arrange servicing as required.
Please let us know as soon as possible if access to your property or wastewater system will not be available at the arranged time.
Payment
Payment is due within 7 days of the invoice date unless another arrangement has been agreed with us in advance.
Where an invoice remains unpaid after its due date, a late payment fee of 10% may be applied to the outstanding balance.
Any costs reasonably incurred in recovering an overdue account may also be charged to the customer where permitted.
If you are having difficulty paying an invoice, please contact us before the due date so we can discuss this with you.
Additional Work and Repairs
Routine servicing may identify maintenance, faults, worn or failed components, damage or other issues requiring additional attention.
Where practicable, we will explain what we have found and discuss recommended repairs or additional work with you.
Repairs, replacement parts, additional labour and other work outside the normal scope of servicing may incur additional charges.
Where specialist work outside the services we provide is required, we may recommend that you contact an appropriate contractor or service provider.
Customer Responsibilities
Customers are responsible for providing accurate information about their wastewater system and advising us of any known faults, previous issues, alterations or other information that may be relevant to the work being undertaken.
Safe and reasonable access must be provided to the wastewater treatment system and associated components.
Access routes and the area surrounding the system must be kept clear of hazards that could create a risk of slipping, tripping or falling. This includes overgrown grass, foliage, vegetation, branches, debris, stored items or other obstructions that may restrict safe access or the technician’s ability to work safely around the system.
Where Fraser is required to clear or remove vegetation, foliage, debris or other obstructions in order to safely access or service the system, additional labour charges may apply.
Please advise us of any known hazards on the property that may affect our ability to carry out the work safely.
Dogs and other animals must be safely secured where necessary to allow us to access and work around the wastewater system.
During Servicing
Wastewater System Servicing must be allowed to carry out servicing, maintenance and repairs without interference with the technician's normal working environment or servicing procedures.
Customers, property owners, family members or other third parties may not participate in, observe for the purpose of training or instruction, or carry out any part of the servicing process unless this has been specifically agreed to by Wastewater System Servicing in advance.
We are happy to explain how your wastewater system operates, discuss our findings and provide homeowners with a general overview of their system. This does not constitute training or instruction in how to undertake servicing, maintenance or repairs.
For health and safety reasons, access to the immediate work area may be restricted while servicing is underway. Wastewater systems can involve potential exposure to wastewater, contaminants, biological hazards, electrical components and other hazards.
Wastewater System Servicing reserves the right to stop or postpone work if interference, changes to the normal working environment, unsafe conditions or the actions of another person prevent the work from being carried out safely or appropriately.
Alterations and Work by Others
Please advise us if any alterations, repairs or other work have been carried out on the wastewater system by the property owner or another person since our previous visit.
Wastewater System Servicing is not responsible for faults, damage, system performance issues or other problems resulting from unauthorised alterations, misuse, incorrect operation, lack of maintenance or work carried out by another person or service provider.
Where alterations or previous work affect our ability to safely or effectively service the system, additional investigation or remedial work may be required and additional charges may apply.
Warranty and Workmanship
We stand behind the quality of the work we carry out.
If you believe there is an issue relating to work completed by Wastewater System Servicing, please contact us promptly so we can assess the situation.
Replacement parts and equipment may be covered by the relevant manufacturer's warranty. Manufacturer warranty conditions and exclusions will apply.
Warranty does not cover faults or damage caused by misuse, lack of maintenance, alterations or work carried out by others, normal wear and tear, external factors or circumstances outside our reasonable control.
Existing Faults and System Performance
Wastewater treatment systems contain mechanical, electrical and biological components, and their performance can be affected by a range of factors outside our control.
Servicing a system does not guarantee that an unrelated component will not subsequently fail or that an existing or developing fault will not become apparent after servicing.
Wastewater System Servicing is not responsible for pre-existing faults, concealed defects or system failures that could not reasonably have been identified during the work undertaken.
We will, however, let you know if we identify anything during servicing that we believe requires attention.
Liability
Wastewater System Servicing will take reasonable care when carrying out work on your property and wastewater treatment system.
To the extent permitted by law, we are not responsible for loss, damage or system failure resulting from pre-existing faults, misuse, unauthorised alterations, work undertaken by others, failure to follow manufacturer recommendations, inaccessible components, environmental conditions or circumstances outside our reasonable control.
Nothing in these Terms and Conditions is intended to exclude or limit any rights or remedies that cannot legally be excluded or limited under New Zealand law.
Privacy
We respect your privacy and will only collect and use personal information reasonably required to provide our services, manage your account, communicate with you and meet relevant administrative, regulatory or reporting requirements.
Where necessary, information relating to your wastewater system or servicing may be provided to relevant parties such as councils, manufacturers, contractors or other service providers where this is reasonably required to carry out our services or meet applicable requirements.
We will not sell your personal information or use it for unrelated purposes.
Changes to These Terms
Wastewater System Servicing may update these Terms and Conditions from time to time.
The current version will be available on our website and will apply to services provided after the updated terms take effect.
